Terms of Service

This is the website of HighMark Business Systems, which designs and builds web and mobile applications for businesses. The site describes what we do, shows work we have delivered for clients, sets out our packages, and gives you a way to start a conversation with us.

It is a marketing and enquiry site. It is not an application you log into, and it does not process orders, bookings or payments.

The enquiry form, our WhatsApp number and our email inbox are checked during working hours. They are not monitored continuously, and no message sent through them is guaranteed to be seen or answered within any particular time. We aim to respond within one business day, which is an intention rather than a promise.

Please do not use this site for anything urgent or time-critical, and do not treat a message as received until we have replied to it. If a matter is genuinely urgent, call rather than send a message.

We do not guarantee that this site will be available without interruption or free of errors. It may be offline for maintenance, for deployments, or because of a problem with our hosting or network provider, at any time and without notice. The same applies to the client applications we link to, which are separate products with their own uptime.

We keep the information here current and truthful, and we only present work as live when it is genuinely live and publicly reachable. Even so, descriptions, timelines, package contents and prices can go out of date, and errors are possible.

Prices shown on this site are indicative starting points, not offers. What a project actually costs depends on its scope, and the figure that binds either of us is the one in a written agreement we have both signed. Nothing on this site constitutes an offer capable of acceptance, or professional advice you should act on without talking to us first.

Case studies, screenshots and recordings of client applications are published with the client’s agreement. Customer details visible in any real screen recording or screenshot are removed before publication. Those applications, and the businesses they belong to, remain the property of the clients concerned.

The text, design, code, images and video on this site belong to HighMark Business Systems or to the clients who own the work shown, except where stated. You are welcome to read, share and link to these pages. Copying the content to present it as your own, or reusing the design or code commercially, is not permitted without our written permission.

This site links to WhatsApp and to applications we have built for clients. Those are run by other organisations. We do not control them, we are not responsible for their content, availability or practices, and following a link means that site’s own terms and privacy policy apply to you instead of ours.

This site is provided as it is. To the fullest extent the law allows, HighMark Business Systems is not liable for any loss or damage arising from your use of it, from being unable to use it, from relying on anything published here, or from any message sent through it not being received or acted on. This includes indirect and consequential loss, such as lost business, lost profits or lost data.

Nothing here limits any liability that cannot lawfully be limited.

We may update these terms as the site changes. The current version is always the one on this page, and the date at the top shows when it last changed. Continuing to use the site after a change means the updated terms apply to you.

These terms are governed by the laws of St. Vincent and the Grenadines, and any dispute arising from them is subject to the exclusive jurisdiction of its courts.
